THE ONLINE SALE OF COUNTERMARKS ON THE www.bustronome.com WEBSITE IS INTENDED FOR PRIVATE INDIVIDUALS AND PROFESSIONALS.
These general terms and conditions of online sale ("GTC") are intended to exclusively govern all relations between the company Bustronome.com, operating under the name "Bustronome.com", SAS with capital of 400,000 euros, whose registered office is located at 4/8 quai de Seine 93400 Saint-Ouen, registered in the Bobigny Trade and Companies Register under number B 797 408 960 ("Bustronome") and its customers (as defined below).
These GTC apply to the exclusion of any other document, with the exception of any special conditions of sale that may apply to an event. If such special conditions exist, they are specified on the event presentation page.
By making a reservation or pre-reservation on the site, you accept and agree to be bound by these terms and conditions, which you expressly acknowledge. You hereby waive the right to rely on any contradictory document.
Bustronome reserves the right to modify all or part of the GTC at any time. You are therefore invited to read the GTC regularly, which are permanently accessible via the link www.bustronome.com. If you do not accept the GTC, you agree not to use the site or any of the services available on the site.
The terms and conditions applicable are those in force on the date the reservation is validated.
"Ticket" means the official document in a ticketing system, which corresponds to a title and proves that the customer, who is the holder, is entitled to enter the premises where the event is taking place.
"Customer" refers to any Internet user using the Bustronome services available on the site, either as an individual or as a professional;
"Counterfoil" means the title corresponding to a receipt, which must be exchanged for one or more Ticket(s) to give entitlement to entry to an event;
"Personal Data" means your name, postal address, e-mail address, telephone number, connection data, and more generally any data concerning you and having a personal nature within the meaning of current French legislation and which is collected through the use of the site;
"Event" refers to lunches, dinners or any other event (such as gouter, breakfast), open to the public, and which is produced or organized by the organizer;
"Pre-Booking Fee" means the cost of pre-booking.
"Booking Fee" refers to the cost of booking a ticket on the site;
"Organizer" means any person organizing an Event and marketing it on the site;
"Pre-Reservation" refers to the service by which Bustronome allows customers to put a purchase option on a ticket for an event;
"Price" refers to the unit value of a countermark; this value includes all taxes and excludes Reservation Fees;
"Global Price" means the total amount of the cumulative prices of the countermarks that are the subject of a Reservation; this amount includes all taxes;
"All-Inclusive Price" means the Total Price to which the Reservation Fee is added; this amount includes all taxes.
"Reservation" refers to any firm and definitive order of Remarks placed on the Site;
"Site" refers to the website accessible via the url www.bustronome.com, whatever the reception terminal (computer, television, telephone, Smartphones, in particular I-Phone or Blackberry, tablets, in particular Ipad or Kindle, and any other terminal allowing the reception, consultation and use of online public communication services), and functionalities of these services (downloading, consultation, etc.), whatever the main destination (France or abroad).
Depending on the event selected, you can either make a firm booking or pre-book the event.
In both cases, you are invited to create an account on the site by entering your contact details, or to log in if you already have an account.
To create an account, you must fill in a registration form, enter your Personal Data and choose a username (e-mail address) and password. You undertake to ensure that the information you enter in this registration form is accurate and correct.
Confirmation of registration and account creation will be sent to the e-mail address given on the registration form.
At any time, you can connect to your "My Bustronome" space using your login and password and follow the progress of your Reservation and/or Pre-Reservation, edit your Counter-Mark or cancel your Pre-Reservation.
You are invited to select the event, the date and the number of places required from the list of events available on the site.
Once you have selected the event, date and number of seats required, you will be taken to a summary page, where you can check the details of your current booking.
You must then check that these elements correspond to your choice. If any of these elements do not suit you, you can click on the "Modify your order" icon at any time to correct the elements of your selection.
This summary is issued for information purposes only and does not constitute a definitive booking at this stage.
Once you have validated the summary of your selection:
- you are invited to read and accept these terms and conditions and any special conditions of sale applicable to the event. If this is the case, the said special conditions are specified on the Event description sheet. You must therefore read the event description carefully to check that you also accept the special conditions applicable to it before finally confirming your order;
A copy of the terms and conditions applicable to your reservation will be sent to you by e-mail in PDF format.
- you are invited to pay online by credit card. For this purpose, the reservation is blocked for a few minutes to allow you to make the payment. As soon as payment has been validated by Bustronome, an e-mail confirming your order will be sent directly to you, and your reservation will be available in your MyBustronome space.
Your order is firm and definitive only upon receipt of the confirmation email sent by Bustronome and accompanied by the reservation purchased or, failing that, upon publication of the reservation on your MyBustronome space. A copy of the General Terms and Conditions applicable on the day of your reservation will be sent to you in the confirmation email.
A "Reservation confirmed" message will appear in your MyBustronome space.
Once you've selected the event, date and number of tickets required, you'll be taken to a summary page where you can check your selections.
Once this verification has been completed, you will be given a pre-reservation number. A purchase option is then registered by Bustronome until your order is fully confirmed.
The purchase option is only valid for a limited period of time, which is communicated to you by Bustronome. If your pre-reservation is not confirmed within this time limit, you will have to make a new pre-reservation.
To confirm your Pre-Booking, you can :

- or validate the procedure by cell phone.
- or to pay a pre-reservation fee online in accordance with the price list appended hereto. These pre-reservation fees will not be reimbursed in the event of cancellation.
Once you have confirmed your pre-reservation, your counter-mark is immediately available on your "MyBustronome" space. You will need to print it out and present it on the day of the event, 15 minutes before the event (unless otherwise indicated on the counter-mark).
It is important to note that in the case of pre-booking, ticket payment is made directly to the venue where the selected event is taking place.
Once your order has become firm and definitive, you will receive a voucher which will be sent to you by e-mail and is available in your "My Bustronome" space.
Only one countermark is issued for each reservation or pre-reservation.
You must print your ticket counter and present it on the day of the event, at least fifteen (15) minutes before the event time. When you arrive, the person in charge of the box office checks that your reservation or pre-reservation is on the list. You are therefore informed that the first person to arrive at the box office with the counterfoil will obtain the associated Ticket(s). It is therefore your responsibility to take all necessary precautions to keep your login and password secret, to prevent them being used by unauthorized persons.
When printing your counterfoil, you must check that your printout contains all the essential elements needed to obtain tickets from the box office in exchange for your counterfoil.
In accordance with article L 121-20-4 of the French Consumer Code, you have no right of withdrawal.
Events take place under the sole responsibility of the organizer.
Tickets cannot be refunded unless the event has been cancelled and Bustronome decides to refund the tickets. In this case, you will be reimbursed directly by Bustronome. The refund is for the amount of the ticket price.
Apart from these conditions, no modification or cancellation of your reservation can be made. The voucher is non-refundable, even in the event of loss or theft. Vouchers cannot be returned or exchanged.
In the event of pre-reservation, the Pre-Reservation Fee is retained by Bustronome even in the event of modification or cancellation of the event.
In the event of cancellation of the event or modification of the time, place or postponement of the date of the event, you will be informed by Bustronome by sending an e-mail to the address you provided and/or, if applicable, by sending an SMS to the cell phone number you provided when creating your account. You will also find all the necessary information concerning modifications to the event in your "My Bustronome" space.
Please note that in the event of postponement of the event, no refund can be made.
Bustronome cannot guarantee that you will receive an email or text message. Therefore, Bustronome recommends that you check during the 24 hours preceding the event, if it is maintained under modification by logging into your MyBustronome space.
When you place your order, you choose the number of seats you require. Placement in the room depends on the organizer's requirements.
Reservations are made in real time. When you place an order, you are informed of availability in real time. In the event of unavailability, you will automatically be offered other available slots.
The Ticket Price is indicated in euros, all taxes included, and corresponds to the price of the ticket that will be given in exchange for the CounterMark.
Depending on the event, booking fees may be added to the ticket price. The price indicated on the site corresponds to the price for a single seat. The All-Inclusive Price due by the Customer is indicated on the booking or pre-booking confirmation page.
It is important to note that in the case of pre-booking, payment is made directly to the restaurant. The pre-booking fee is separate from the price and is due to Bustronome for all pre-bookings.
In the event of a promotion or special offer, Bustronome undertakes to apply the promotional price to all bookings made during the period of the promotion.
Bustronome reserves the right to change prices at any time, but countermarks are billed on the basis of the prices in effect at the time your reservation is finalized.
Tickets and counter-marks may not be resold. In this respect, we would like to remind you that, in accordance with the provisions of article L.313-6-2 of the French Penal Code, "the act of selling, offering for sale or exhibiting for sale or transfer, or providing the means for the sale or transfer of admission tickets to a sporting, cultural or commercial event, or to a live performance, on a regular basis and without the authorization of the producer, organizer or owner of the exploitation rights for this event or performance, is punishable by a fine of €15,000. This penalty is increased to €30,000 in the event of a repeat offence". For the purposes of the law, "any ticket, document, message or code, regardless of form or medium, attesting to the fact that the right to attend the event or show has been obtained from the producer, organizer or owner of the exploitation rights" is considered to be an admission ticket.
Only online payment by credit card is accepted.
Credit cards accepted are Carte Bleue, Visa, Mastercard, Eurocard and American Express.
Payment by credit card allows you to reserve tickets online and immediately, firmly and definitively.
The transaction is immediately debited from your credit card after verification of your credit card details, and upon receipt of debit authorization from the credit card issuer.
By providing your credit card details, you authorize Bustronome to debit your credit card for the amount corresponding to the All-Inclusive Price. In this respect, you declare that you are the holder of the credit card to be debited and that the name appearing on the card is indeed yours.
If it is impossible to debit the All-Inclusive Price, the online sale is immediately cancelled and the reservation cancelled.
All payments made on the site are secured via our payment service provider, Banque Populaire, which is the sole recipient of your bank details.
What's more, to protect you from fraud, your bank may ask you for an authentication code to verify that you are the owner of the credit card you are using.
You declare that you are fully aware of the characteristics and limits of the Internet, through which Bustronome provides the site and the "My Bustronome" space.
You therefore acknowledge that:
- Data transmissions over the Internet are only relatively reliable, as they circulate on heterogeneous networks with different characteristics and technical capacities, which are sometimes saturated at certain times of the day;
- data circulating on the Internet are not protected against possible misappropriation, and may be subject to capture of the information disseminated.
- it is impossible to control the use that may be made of it by third parties on the Internet.
As a result, Bustronome cannot be held responsible for any of the facts or events mentioned above. Bustronome shall not be held liable in the event of force majeure, including but not limited to malfunction of the Internet network, telephone lines or reception equipment preventing or hindering use of the site or your "My Bustronome" space.
By making a reservation or pre-reservation on the site, you agree to comply with the provisions of the GTC applicable at the time of your reservation or pre-reservation.
Violation of the provisions of the GTC by you may result in suspension of access to the site and closure of your "My Bustronome" space, without prejudice to any damages that Bustronome may seek.
Consequently, Bustronome reserves the right to refuse any reservation or pre-reservation that contravenes or has contravened the provisions of the GTC.
You are responsible for all the data you enter directly on the site and in your "My Bustronome" area.
Bustronome draws your attention to the fact that it is your responsibility to implement all necessary measures to maintain the confidentiality of the password used to access your "My Bustronome" area.
The information and your Personal Data are necessary to manage your reservation, your "My Bustronome" space and our commercial relations, to send Bustronome.com newsletters and to send "email alerts".
Before placing your order, you must update your contact details and make sure that your Personal Data is correct. We may contact you to inform you of any changes to the time or place of the event, or of any cancellations.
In accordance with the provisions of article 22 of law no. 78-17 of January 6, 1978, amended by law no. 2004-801 of August 6, 2004, the processing of Personal Data collected from registration forms has been declared to the French Data Protection Authority (Commission Nationale de l'Informatique et des Libertés). The person responsible for processing Personal Data is Bustronome.
The Personal Data collected and processed by Bustronome by means of the registration forms for your "My Bustronome" space are confidential.
If you have expressed your consent when entering your Personal Data by ticking the box "I agree to receive offers from your partners", Bustronome reserves the right to pass on your Personal Data to our partners, who may then send you commercial solicitations directly.
You may, by providing proof of your identity, exercise your right to access, rectify, delete and object to your Personal Data by writing to Bustronome SAS, 4/8 quai de Seine, 93400 Saint-Ouen or by e-mail to the following address: [contact@bustronome.com].
When you log on to the site and/or your "My Bustronome" space, a cookie is automatically installed on your computer's hard drive by your browser.
These cookies are very small text files which record information about your browsing on the site (pages viewed, date and time of connection, etc.) from the computer on which the cookies are stored.

However, Bustronome draws your attention to the fact that, in such a case, access to certain services on the site may be altered, or even impossible.
The Site and all its components, whether in terms of structure, appearance or content (such as data, databases, text, graphics, animated or non-animated images, sound, drawings, graphics, logos, names, trademarks, designations, tabs, functionalities, the Content) are the property of Bustronome or are subject to a concession of rights granted for its benefit. The Site and its content are subject to the provisions of the French Intellectual Property Code and as such are protected against any unauthorized use by law or these GTC.
Any rights relating to the site and/or its content (such as the right to reproduce, represent and/or distribute all or part of its content) other than those expressly granted under these GTS, must be expressly authorized by the holder of the rights in question. Consequently, any unauthorized use of the site and/or its content may be subject to legal action for infringement and/or unfair competition and/or parasitism on the part of the holder of the rights in question.
All elements of the site downloaded by a third party with a view to facilitating the visibility and promotion of events available on the site are and remain the exclusive intellectual property of the latter. No one is authorized to reproduce, exploit, rebroadcast or use for any purpose whatsoever, even partially, any elements of the site, whether software, visual or audio.

You agree to communicate primarily with Bustronome by electronic means. Bustronome's computerized registers are authentic and are considered as admissible, valid and opposable proof of communications, reservations, payments and transactions between Bustronome and yourself.
The same evidential value is attributed to ticking the words "I wish to reserve these seats definitively for the [date of the event] at [time of the event], [place of the event] and I unreservedly accept the general conditions of sale. Reservations are non-cancellable, non-deferrable and non-refundable" as stipulated in article 4 hereof, than a handwritten signature.
You agree not to contest the admissibility, validity, enforceability or probative value of the aforementioned elements of an electronic nature or format, on the basis of their electronic nature. In the absence of proof to the contrary, these elements will be valid and opposable between Bustronome and yourself in the same way, under the same conditions and with the same probative force as any document drawn up, received or kept in writing on a physical medium.
The computerized registers are kept in the site's systems in compliance with the rules of the art in terms of security. All information and documents are archived on a medium capable of ensuring the faithful and durable nature required by the legal provisions in force.
Bustronome accepts no liability in the event of force majeure, including in particular malfunction of the Internet network, telephone lines or reception equipment, preventing or hindering use of the site.
These terms and conditions are governed by French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.
